General Terms and Conditions

These General Terms and Conditions apply to all deliveries and services provided by relate Commerce GmbH (sokke.ch), Blegistrasse 9, 6340 Baar. These General Terms and Conditions are accepted by the customer upon the conclusion of the contract (see point “Offer and Contract”).

Offer and Contract
Offers issued by relate Commerce GmbH are non-binding. Telephone consultations by the staff of relate Commerce GmbH are also non-binding. The contract is concluded as soon as the customer confirms the offer and the resulting order by email or in writing.

Prices and Payment
The prices in the catalog or the form on sokke.ch are exclusive of VAT and serve only as a guideline (unless otherwise stated). The price already includes free home delivery and any customs fees.

For orders less than USD / £ 3,000 or USD / £ 2,700, the entire invoice amount is due upon placing the order.

For orders over USD / £ 5,000 or USD / £ 4,700, the invoice amount is divided into two installments of 50% each. The first installment is due upon placing the order. The second half of the invoice amount must be paid immediately upon receipt of the goods.

Relate Commerce GmbH reserves the right to execute pending deliveries against advance payment or deposit.

Withdrawal from Contract
The buyer has the right to withdraw from the contract within 14 days of placing the order.

In the event of withdrawal by the buyer, a flat fee of USD / £ 500 will be charged.

The fee will be deducted from the already paid purchase price, and the remaining amount will be refunded to the buyer.

The seller reserves the right to withdraw from the contract if the ordered socks cannot be delivered for reasons beyond the seller’s control. In this case, the buyer will be informed immediately, and any amounts already paid will be refunded.

The stated delivery times are always guidelines and are not guaranteed. Payment received is considered the start of production. Relate Commerce GmbH declines any liability for delivery delays. The customer is not entitled to withdraw from the contract due to delivery delays.

Over- or Under-Deliveries
Over- or under-deliveries of up to 5% of the ordered quantity are industry standard and cannot be contested. The actual delivered quantity will be invoiced.

The customer has no right to return the products offered on sokke.ch. Exchanges or returns due to dissatisfaction or similar reasons are rejected.

Deviations in colors and patterns cannot be completely excluded due to the materials and manufacturing techniques used.

Unless otherwise agreed with relate Commerce GmbH, the products are produced for unisex and in “One-Size,” suitable for shoe sizes from 38 to a maximum of 45 (no guarantee). These sizes are guidelines and may have slight deviations. If sizes other than “One-Size” are agreed upon, the same regulations apply (See point “Size Tolerance”).

Size Tolerance
The materials used in production are woven and are subject to the size tolerance for woven textiles, which is 3.5%. The customer acknowledges this tolerance upon order confirmation.

Defects in the goods supplied by relate Commerce GmbH must be reported within 7 days of receipt of the goods. This can be done in writing or by email.
If the customer allows this deadline to pass, the goods are considered to be free of defects and thus accepted.

Relate Commerce GmbH is obliged to compensate for defective goods with a replacement delivery. Relate Commerce GmbH may, at its discretion, grant a price reduction corresponding to the loss in value instead of a replacement. In the case of defects, the customer has no right to withdraw from the contract. Defects or damages due to force majeure are excluded from the warranty.

Best Price Guarantee
Our Best Price Guarantee (hereinafter referred to as “Guarantee”) applies to the purchase of individually designed socks at Sokke. By taking advantage of the Guarantee, you agree to the following conditions:

  1. The Guarantee applies exclusively to identical sock products with the same specifications, design, and quality.
  2. You must send us a written copy of the competitor’s offer so that we can review it.
  3. We reserve the right to decline the Guarantee if the competitor’s offer is not feasible for us.
  4. The adjustment of the price is at our discretion to ensure that we can continue to offer top-quality and service.
  5. Our Guarantee does not apply to offers from foreign providers or private sellers.
  6. The decision to adjust the price is made by Sokke and is final.
  7. We reserve the right to change or revoke the terms of the Guarantee at any time without prior notice.

By taking advantage of the Guarantee, you agree to these terms. Our Guarantee does not constitute a binding legal commitment and cannot be interpreted as a legal agreement.

Use of Customer Projects for Advertising Purposes
(1) Relate Commerce GmbH is authorized to use selected designs and projects created by it for customers for advertising and presentation purposes in online and offline publications, particularly on the company’s social media channels. These publications serve to present the quality of relate Commerce GmbH’s work to a larger audience and to illustrate the quality of the services offered to potential customers.

(2) If a customer objects to the use of their designs or projects for the purposes mentioned in paragraph (1), they can notify relate Commerce GmbH in writing. The customer has a right to object, which can be exercised within 30 days of receiving information about the planned use of the designs or projects. In this case, relate Commerce GmbH will not use the relevant designs or projects for advertising purposes.

(3) Relate Commerce GmbH commits to respecting the personality rights and intellectual property of customers and not to disclose any confidential information in connection with the published designs or projects.

If you offer our textile products for resale to end customers, you must ensure, according to EU labeling regulations, that the products are labeled with a tag that clearly indicates the composition of all used textile fibers and the proportion of all non-textile parts of animal origin. This is a legal obligation to ensure that consumers are adequately informed and can make an informed purchase decision. Please note that the absence of correct labels for textile products for resale may have legal consequences, including fines and criminal prosecution.

Confidentiality / Data Protection
The customer is not authorized to disclose information about prices and contractual conditions to unauthorized persons and is obliged to maintain confidentiality.

With the mutual consent of the customer, relate Commerce GmbH is authorized to publish produced products for advertising purposes in the form of online and offline publications.

Consent to Receive Marketing Communications
By filling out and submitting a request through our website/platform, you agree that we may occasionally send you marketing materials and campaign information about our products, services, and offers. This communication may occur through various channels, including but not limited to email, SMS, social media, or postal mail.

You have the right to withdraw your consent at any time and unsubscribe from our marketing list by following the instructions in our communications or by contacting us directly. We commit to handling your data in accordance with our privacy policy and applicable law.

Severability Clause
Should individual provisions of these General Terms and Conditions or further agreements between the customer and relate Commerce GmbH prove to be invalid or unenforceable, this does not invalidate the entire contractual relationship, but the relevant provisions should be meaningfully replaced by valid ones.

Applicable Law and Jurisdiction
Should provisions of these General Terms and Conditions be partially ineffective or become so, the remaining conditions remain effective. The parties are obliged to replace the ineffective provisions with a legally valid regulation that comes as close as possible to the economic and legal purpose of the ineffective provision.

Changes to these GTC are possible at any time. The status at the time of each order applies.

Swiss law applies exclusively; the place of jurisdiction is Zug, Switzerland.
